  • 3.2. This Agreement is not a fictitious or sham transaction and is entered into without coercion or deception.
  • 3.3. The Customer understands and agrees that the composition, scope, availability and actual operation of individual features, modules, automation scenarios, integrations and other software capabilities may be changed, restricted, temporarily suspended, removed or expanded. This may result from changes to Telegram or other third-party platforms, their rules and restrictions, the technical relevance of individual scenarios, anti-spam and anti-abuse mechanisms, infrastructure conditions or other users' general use of the software. Such changes do not in themselves constitute improper provision of services or grounds for a refund, unless expressly required by mandatory provisions of applicable law.

4. Rights and Obligations of the Provider

  • 4.1. The Provider must comply with this Agreement, provide services of appropriate quality and objectively describe goods, services and terms on anygram.io.
  • 4.2. The Provider may suspend services, restrict functionality, revoke activation or license keys, block the Customer's account or terminate a license for breaches of this Agreement, the User Agreement, service rules, legal requirements or third-party rights. This also applies to attempts to hack, circumvent technical restrictions, reverse engineer, decompile or interfere with the Service, API, infrastructure, updates, licensing mechanisms or other Anygram components. In such cases, no refund is made for the paid but unused period unless expressly required by mandatory provisions of applicable law. The Provider may also exercise other rights under law and this Agreement.

5. Rights and Obligations of the Customer

  • 5.1. The Customer must pay for services and goods on time and read the information published on the Provider's website.
  • 5.2. The Customer has the right to:
    • place Orders on anygram.io;
    • require proper provision of services under this Agreement;
    • exercise other rights under law and this Agreement.

6. Ordering Procedure

  • 6.1. The Customer places an order on the relevant anygram.io page by registering, funding the internal balance through available payment systems, selecting a product or license and confirming the balance deduction.
  • 6.2. The Provider processes orders within 3 (three) business days of placement, unless otherwise specified on the product page. Orders placed on weekends or public holidays are processed starting on the next business day.

7. Price and Payment Procedure

  • 7.1. The Provider determines the price of each service or product and lists it on the relevant anygram.io page. The order total is the sum of the selected items.
  • 7.2. Payment is made by funding the account's internal balance through payment systems available on the website, including bank cards and electronic payments.
  • 7.3. Payment occurs when funds are credited to the internal balance following confirmation by the payment system. Licenses, subscriptions and other goods are charged to the internal balance when the order is confirmed.
  • 7.4. An invoice is valid for 3 banking days unless otherwise stated on the invoice.
  • 7.5. The Customer independently pays for third-party services needed to receive the Provider's services, such as internet access and payment provider fees where applicable.
  • 7.6. By funding the internal balance, placing an Order or paying for a digital product, the Customer agrees that performance of this Agreement and access to a digital product, license, activation key or other functionality may begin before the withdrawal period expires, to the extent permitted by applicable law.
  • 7.7. As a general rule, no refund is made after funding the website's internal balance, paying for a digital product, receiving an activation key, activating a license or obtaining access to functionality.
  • 7.8. As an exception, the Provider may at its discretion consider a refund if, within 24 hours of the license purchase, the software fails to start or cannot be used for its primary purpose for reasons attributable to the Provider, as confirmed by the Provider's investigation.
  • 7.9. After 24 hours from the license purchase, no refund is made on the grounds stated in clause 7.8.
  • 7.10. This section does not restrict mandatory Customer rights expressly provided by applicable law where digital goods or services fail to conform to the contract, or where a refund, price reduction, remedy of defects or another remedy is required by law.

8. Receipt and Acceptance of Services

  • 8.1. Rules for providing and receiving services appear on the relevant anygram.io pages and form appendices to this Agreement.
  • 8.2. For an individual Customer, payment for the Provider's services or goods by deduction from the internal balance confirms receipt of the services.
  • 8.3. Before the license expires, the Customer must independently export all data, accounts, settings and other items they need from the software in good time. After expiration, the Provider may restrict or terminate access to the software, associated data and export functions. Claims arising from the Customer's failure to export before expiration will not be satisfied.

9. Liability and Disputes

  • 9.1. The Parties are liable under applicable law for non-performance or improper performance of their obligations.
  • 9.2. Disputes are resolved through negotiation. If no agreement is reached, they are submitted to the court with proper jurisdiction.
  • 9.3. The Provider is not liable for failure or improper provision of services due to circumstances beyond its control, including actions or omissions of the Customer, third parties or force majeure.
  • 9.4. The Provider is not liable for bans, freezes, deletion, restrictions, loss of access or other adverse consequences affecting the Customer's Telegram accounts, bots, channels, chats, stories or other entities where caused by Telegram or other third parties, the Customer's violation of third-party platform rules or circumstances beyond the Provider's control.
  • 9.5. Claims for reimbursement of account costs, digital assets, lost profits or other losses associated with bans, freezes, deletion or restrictions on third-party platforms while using the Provider's services will not be satisfied.

10. Force Majeure

  • 10.1. The Parties are exempt from liability where obligations are not performed due to force majeure.
  • 10.2. Force majeure means circumstances beyond the Parties' reasonable control that cannot be foreseen or prevented, including war, civil unrest, epidemics, natural disasters and government decisions, which make performance wholly or partly impossible.
  • 10.3. If force majeure lasts for more than 3 months, either Party may discontinue further performance without compensating the other Party for losses.

11. Other Terms

  • 11.1. Each Party confirms that it has the legal capacity and authority to conclude and perform this Agreement.
  • 11.2. The Customer may not unilaterally amend the terms or refuse performance except as provided by this Agreement. Rights and obligations may be transferred to third parties only by mutual consent.
  • 11.3. Customer information is confidential and used to fulfill the order. By accepting this Agreement, the Customer consents to personal data processing for performance and communications, including newsletters; this consent may be withdrawn on request.
  • 11.4. The Provider is not responsible for the content or accuracy of information supplied by the Customer when placing an order.
  • 11.5. The Customer may use the Provider's services only for its own activities, without transferring them to third parties, unless the specific product's terms provide otherwise.
  • 11.6. License and activation keys are supplied for the Customer's own use and may not be transferred, sold, exchanged, published or otherwise provided to third parties without the Provider's separate written consent.
  • 11.7. The Customer must not attempt to hack the software, accounts, licensing mechanisms, activation keys, API, infrastructure, updates or other Provider components, or reverse engineer, decompile, modify or circumvent technical restrictions, safeguards, limits, licensing or access controls.
  • 11.8. Without the Provider's separate written consent, the Customer must not resell, sublicense, transfer or otherwise provide third parties with access to the Provider's services, API, API keys or features in an unchanged or insignificantly modified form, including through its own panels, wrapper/proxy APIs, white-label solutions or similar services.
  • 11.9. The Parties must keep information obtained in performing this Agreement confidential, except where disclosure is required by law or authorized by the other Party.
  • 11.10. This Agreement is public and of indefinite duration, remaining effective until terminated under its terms or law, but for no less than 3 calendar months from acceptance. It is deemed concluded at the Provider's location on the date of acceptance.
  • 11.11. The Provider may amend or supplement this Agreement and its appendices. The current version published on anygram.io, including /public-offer, is considered effective.
